Visit or interact with independently owned and operated KOA franchise locations, which may have their own privacy practices and technologies not controlled by KOA; or
Interact with third-party digital assets (as defined below) that are linked to or accessible from the Services.
2. Type of Personal Information Collected; Source of Personal Information
The types of Personal Information we collect about you depend on your interactions with us and on our Services. In this section, we describe the categories of Personal Information we collect, organized by the sources of this data. By interacting with the Services, you grant us the right to use your Personal Information to enable us to evaluate your application, manage the recruitment process, and for other uses as stated in this Privacy Notice. If you do not provide your Personal Information when requested, you may not be able to use our Services or submit your application, in whole or in part: (a) if that Personal Information is necessary to evaluate your candidacy or (b) if we are legally required to collect the requested Personal Information.
2.1 Personal Information You Directly Provide to Us
In addition to any other categories of Personal Information we state we are collecting at the time of collection, we may also collect the following Personal Information that you provide directly to us:
Identifying Data. Data by which you may be identified such as name, postal address, phone number, email address, or any other data identifiable to you.
Employment, Education, and Application Data. Data relating to your professional and educational background and application materials, including employer names, positions held, dates of employment, reason for leaving, salary history (where permitted by law), professional accomplishments, schools attended, degrees or diplomas obtained, certifications, professional licenses, transcripts, dates of attendance or graduation, your resume or curriculum vitae, cover letter, work samples, portfolio materials, responses to application questions, and professional references.
Communications Data. Data contained in your communications with our recruiting team, including emails, messages through the applicant portal, interview notes and feedback, and the date and time of your communications.
Login Data. Data related to your applicant portal account such as your username and password.
For Residents of Canada: Personal Information does not include any contact information that is solely used to communicate with you in relation to your employment, business or profession, such as your name, position name or title, work address, work telephone number, or work email address.
2.2 Personal Information Automatically Collected About You
As you navigate through and interact with our Services, we, our service providers, or other third parties may use cookies, log files, and other automatic data tracking technologies (“Automatic Tracking Technologies”) to collect certain data about your equipment, browsing actions, and patterns, including the following types of data:
Device Data. Data when you interact with the Services such as technical data about your device including your IP address, unique identifiers, device type, browser type, version, and language, operating system, and similar device data.
Usage Data. Data about your visits to and usage of our Services including usage details (date/time/duration on a given webpage), traffic data, logs, general location and time zone based on your IP address, and navigation paths within the webpages, such as job listings viewed, searches performed, and features used.
2.3 Personal Information We Collect from Other Sources
We may receive the data described above from other sources such as service providers and other third parties who help us provide the Services. These other sources we may receive data from include the following:
Service Providers. We may use service providers to provide the Services to you or for any other purpose described in the How We Use Your Personal Information section below. These include our applicant tracking system provider, background check providers, assessment tool vendors, and interview scheduling platforms. These service providers have contractual obligations regarding how they are allowed to use the data we provide to them.
Affiliates or Subsidiaries. KOA may receive or share information among corporate entities and related business units for recruiting coordination and hiring administration.
References. We may receive information about you from the professional references you provide to us, former employers, or educational institutions.
Publicly Available Sources. We may collect information from publicly available professional profiles (e.g., LinkedIn) or other publicly available information relevant to your application, where permitted by applicable law.
3. How We Use Your Personal Information
We, along with our service providers or other third parties, may use your Personal Information for the purposes described below. We may use your data for the following purposes:
Evaluate Applications and Qualifications. To review and assess your application, qualifications, skills, and experience for the position(s) to which you have applied or for other positions that may be a fit.
Facilitate Franchisee Hiring. To transmit your profile, application, resume, and other related materials to the relevant KOA franchisee(s) to which you apply, so that the franchisee may evaluate your application and manage its hiring process.
Communicate with You. To communicate with you regarding your application status, schedule interviews, request additional information, and respond to your inquiries about open positions or the recruitment process.
Improve the Recruitment Process. To monitor and analyze trends in applications and recruitment activities, improve the applicant experience, and enhance the efficiency and effectiveness of our recruiting operations.
Provide Safety and Security. To detect and protect against malicious, deceptive, or illegal activity, including fraudulent applications, security incidents, and harm to the rights, property, or safety of us and our employees or others.
Facilitate Corporate Transactions. In anticipation of or in connection with a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of KOA’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which the data held by KOA is among the assets transferred.
For Administrative Purposes. To manage our day-to-day business and operations, and record-keeping obligations.
Comply with Legal Obligations. To comply with our legal or regulatory obligations, including those related to the prevention of fraud, and those required for you to benefit from rights recognized by law, or any regulatory requirements or provisions.
Obtain Your Consent. In accordance with: (i) the way we describe to you when you provide the data to us; (ii) your instruction or intentional direction; or (iii) any other way when you consent.
We may also aggregate or de-identify Personal Information and use it without restriction, including but not limited to for research, data analysis, to improve our recruitment processes, and for other purposes consistent with applicable law. We will maintain aggregated or de-identified data in a form that cannot reasonably be used to infer data about, or otherwise be linked to, a particular individual.
For Residents of Canada: We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent. Please note that we may retain Personal Information in our backups or archival records.
For Residents of Canada: You can withdraw your consent to the collection, use or disclosure of your information that is under our control at any time. However, in some cases withdrawing consent will mean that we can no longer provide you with certain services or perform certain tasks where the information is required to do so. 4. Whom We Share Your Personal Information With & The Purpose of Disclosure
We may disclose Personal Information that we collect from you or that you provide as described in this Privacy Notice to the following categories and for the purposes set forth below:
Service Providers. We disclose Personal Information to unaffiliated companies or individuals we hire or work with that perform services on our behalf, including our applicant tracking system provider, web hosting, information technology services, background check providers, assessment and testing platforms, interview scheduling services, and human resources information system (HRIS) providers. These service providers may have access to data we collect from you to perform the specific services we request from them.
Franchisees. When you submit a profile, application, resume, or other materials through the Services, we disclose your Personal Information (including your contact information, employment and education history, and application materials) to the relevant KOA franchisee(s) so that they may evaluate your application and manage their hiring process. Once your Personal Information is disclosed to a franchisee, the franchisee’s use of that information is governed by the franchisee’s own privacy practices, and any request to access, correct, or delete data held by a franchisee must be directed to that franchisee.
Affiliates / Subsidiaries. We may disclose your Personal Information to our parent company, subsidiaries, and other companies under common ownership or control with us for purposes consistent with this Privacy Notice, including hiring coordination across KOA corporate entities and owned/operated campground locations.
Corporate Transaction. Your Personal Information may be disclosed or transferred in anticipation of or in connection with a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of KOA’s assets or equity, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which data held by KOA is among the assets transferred.
Law Enforcement Authorities and Individuals Involved in Legal Proceedings. 5. How We Protect Your Personal Information

If you are not hired, we may retain your application information for a reasonable period to consider you for future opportunities, unless you request deletion.
If you ask us to delete your Personal Information, there may be some latency in deleting this data from our servers and back-up storage and some data may not be completely removed from our logs and other records. In addition, we may retain this data if necessary to comply with our legal obligations, resolve disputes, defend against claims, or enforce our agreements.

7.2 Automatic Tracking Technologies
We and other third parties may use Automatic Tracking Technologies on the Services. This Privacy Notice does not apply to these third-party Automatic Tracking Technologies because we do not control the data collected by them.

To the extent necessary to carry out our business needs or if required under applicable law, we may disclose your Personal Information to a third party as part of a corporate transaction, to law enforcement or professional advisors, or under your direction or consent, to other third parties.
5. Sale or Sharing of Personal Information; Targeted Advertising
We may sell or share Personal Information collected through Automatic Tracking Technologies with Analytics Providers. This may be considered a sale or sharing of Personal Information under the Privacy Laws.
6. Data Retention

Personal information is retained as long as necessary for recruitment and hiring purposes, as well as for business, legal, tax, accounting, contractual, fraud prevention, security, operational, dispute resolution, and compliance purposes.
If you are not selected for a position, we may retain your application data for a reasonable period to consider you for future opportunities unless you request that we delete your data. In all cases, applicant data will be retained for the minimum period required by applicable employment laws and regulations.

7.3. Data Correction Rights
Under certain California laws, you have the right to request that we correct inaccurate Personal Information that we collected from you and retained, taking into account the nature of the Personal Information and the purposes of processing Personal Information. Once we receive and confirm your request (see Exercising Your Rights for more information), we will use commercially reasonable efforts to correct the inaccurate Personal Information from our records, unless an exception applies.
7.4. Deletion Rights
Under certain California laws, you have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your request (see Exercising Your Rights for more information), we will delete (and where required by applicable law, direct our service providers to delete) your Personal Information from our records, unless an exception applies.
These exceptions include retaining the data if it is necessary for us or our service provider(s) to:
Complete or fulfill the purpose for which the Personal Information was collected, including evaluating your application or considering you for future opportunities.
Comply with employment-related legal obligations, including record-keeping requirements under federal and state employment laws.
Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
Exercise free speech, ensure the right of another individual to exercise their free speech rights, or exercise another right provided for by law.
Comply with applicable law, including the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.).
Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us.
Make other internal and lawful uses of that data that are compatible with the context in which you provided it.
8. Exercising Your Rights

To be verifiable, a request must:
Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information and that you have rights under this California Specific Disclosure.
Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
If applicable, provide sufficient information that allows us to reasonably identify you as an authorized representative of the person whose Personal Information we collected.
We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.
Making a request does not require you to create an account with us, but we may require authentication of the person requesting the data that is reasonable in light of the nature of the Personal Information requested. We will only use Personal Information provided in a request to verify the requestor’s identity or authority to make the request. You may also designate an authorized agent to submit a request on your behalf using the contact information above, though we may still require you to confirm your own identity directly with us, verify that you provided the agent written authorization to act on your behalf, or require the agent to provide proof of that written authorization before we act on the request.
8.1. Initial Request
Once received, we endeavor to respond to a request within the allotted time required by law. If we require more time, we will inform you of the reason and extension period in writing.
The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance, to the extent technically feasible.
We do not charge a fee to process or respond to your request unless it is excessive or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
9. Non-Discrimination
We will not discriminate against you, as described in Privacy Laws, for exercising any of your rights under Privacy Laws. Unless permitted by Privacy Laws, we will not:
Deny employment consideration or services.
Provide a different level or quality of services during the recruitment process.
Suggest that you may receive different treatment in the recruitment process.
